TO THE FULLEST EXTENT PERMITTED BY LAW, RICS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF LIABILITY IS IMPOSED BY A COURT NOTWITHSTANDING THIS LIMITATION, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) FIFTY U.S. DOLLARS ($50.00); OR (B) THE AMOUNT YOU PAID TO RICS, IF ANY, IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless RICS, its subsidiaries and/or affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Website, your breach of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. These Terms of Use, together with the Privacy Policy and any other legal notices published by RICS, constitute the entire agreement between you and RICS concerning your use of the Website and supersede any prior agreements or understandings, whether written or oral.
